RESOLUTION No. 2000-2
PROVIDING FOR THE ESTABLISHMENT OF AN ASIAN REGIONAL TRIBUNAL
WHEREAS, violations of human rights undermine respect for the inherent dignity of persons and respect for the rule of law and fundamental freedoms;
WHEREAS, there remain many gross human rights violations in many Asian countries;
WHEREAS, the perpetrators of these violations must be brought to justice to avoid repetition and to convey the vigorous message that Asians value the worth and dignity of every person;
WHEREAS, Asian governments must draft a Regional Declaration condemning the act of involuntary disappearance;
WHEREAS, Asian governments must endeavor to establish a tribunal vested with jurisdiction to try and decide cases of human rights violations irrespective of the country where such violations were committed in the Asian region.
NOW, THEREFORE, we call on Asian governments to draft a Declaration condemning the act of involuntary disappearance;
BE IT RESOLVED as it is hereby resolved that Asian governments establish an Asian Regional Trial Court that can try and decide cases of human rights violations irrespective of the country where such violations were committed in the Asian Region;
BE IT RESOLVED FURTHER that the decision of this Asian Regional Tribunal shall be enforced as a final and executory judgment by the appropriate national or domestic court of competent jurisdiction;
BE IT RESOLVED FINALLY that the establishment of the Asian Regional Tribunal be contained in an international convention to be ratified by the countries concerned.
