Country Resolution on Enforced Disappearances in Sri Lanka
Resolution
WHEREAS Africa, the Americas and Europe have adopted their own Human Rights
Charters and Monitoring Mechanisms and established special judicial
tribunals under those Charters for the protection and promotion of Human
Rights in their respective regions and concerned that no such mechanisms
have yet been established in Asia;
WHEREAS the open-ended working group appointed by the United Nations
Commission on Human Rights and subsequently by the new-founded Council on
Human Rights adopted a Convention for the Protection of all Persons from
Enforced or Involuntary Disappearances;
WHEREAS the United Nations Working Group on Enforced or Involuntary
Disappearances (UNWGEID) and Presidential Commissions against enforced or
involuntary disappearances appointed by Her Excellency the President of Sri
Lanka have submitted extensive recommendations to the Government of Sri
Lanka in respect of dispensing transitional justice to the victims and their
families;
WHEREAS welcoming that the Presidential Commission was appointed by His
Excellency the President of Sri Lanka, to investigate and inquire into cases
of enforced disappearances and other human rights violations committed since
August 2005;
Therefore we, the participants of the Third Congress of the Asian Federation
Against Involuntary Disappearance AFAD guided by the theme - "Coming
Together: Forging a Global Respect for the Right not to Be Disappeared" -
held in Kathmandu, Nepal, from December 16 to 18, 2006, RESOLVE hereby to
strongly urge the Sri Lankan government to undertake the following measures:
To adopt the Asian Human Rights Charta of 1998 which will be a decisive step
for the establishment of an Asian Convention on Human Rights, in order to
provide for monitoring mechanisms and special judicial tribunals in Asian
countries, and to encourage other Asian governments to do so.
To ratify the forthcoming Convention on the Protection of all Persons from
Enforced or Involuntary Disappearance without any reservations and to invite
other Asian state parties to the United Nations to do the same.
To implement all the recommendations issued by the UN Working Group on
Enforced or Involuntary Disappearance during its three visits to the country
without further delay.
To empower the Presidential Commission which was set up to investigate cases
grave human rights violations, including enforced disappearances, in order
to bring those responsible to justice when concrete evidence is available.
