RESOLUTION URGING THE PHILIPPINE GOVERNMENT TO
PASS THE PROPOSED ANTI-ENFORCED OR INVOLUNTARY DISAPPEARANCE ACT OF 2003
WHEREAS, enforced or involuntary disappearance is an odious offense that
violates practically all human rights including the right to life;
WHEREAS, the Families of Victims of Involuntary Disappearance and other
human rights organizations in the Philippines have steadfastly lobbied
since 1995 for the enactment of a law that penalizes enforced or
involuntary disappearance;
WHEREAS, a draft consolidated bill entitled the "Anti-Enforced or
Involuntary Disappearance Act of 2003" was jointly approved by the
Committee on Justice and Committee on Civil, Political and Human Rights in
February 2003 and is pending before the Committee on Appropriations of the
House of Representatives of the Philippine Congress;
WHEREAS, Senate Bill 2562, which is identical with the consolidated bill
in the House of Representatives, and Senate Bills 1854 and 1856 still
await committee action in the Senate of the Philippines;
WHEREAS, the said bills adopt with slight modification the definition of
enforced or involuntary disappearance in the United Nations Declaration on
the Protection of All Persons From Enforced or Involuntary Disappearances
and contain many of the important provisions of the said Declaration;
WHEREAS, the said bills seek to criminalize the perpetration of enforced
or involuntary disappearance and promise to be the first legislation of
its kind in Asia.
NOW, THEREFORE, the Asian Federation Against Involuntary Disappearances
(AFAD) resolves to:
Urge the President of the Republic of the Philippines to certify the
proposed "Anti-Enforced or Involuntary Disappearance Act of 2003" as a
priority measure of the present administration;
Urge the House of Representatives and the Senate of the Philippines to
enact the proposed law during the 12th Congress;
Send copies of this resolution to the President of the Republic of the
Philippines and the members of the Philippine Congress.
Done this 30th day of August 2003 in Bangkok, Thailand during the occasion
of the Second Congress of the Asian Federation Against Involuntary
Disappearances and the commemoration of the International Day of the
Disappeared.
