Country Resolution on the Murder of Munir
Resolution
WHEREAS taking into account that enforced or involuntary disappearances as
well as extrajudicial killings are recognized as crimes against humanity
in international human rights law;
WHEREAS referring to the U.N. Declaration on the right of any
organization, group or person to defend and to promote international human
rights principles, adopted by the UN General Assembly in December 1998;
WHEREAS enforced disappearances were practiced in Indonesia in 1997-98 and
no thorough investigations have been carried out in order to establish the
whereabouts of the disappeared persons, in spite of growing universal
recognition of the right not to be disappeared as well as the right for
the bereaved to know the truth;
WHEREAS highly concerned at the fact that in the case of the assassination
of Mr. Munir, founder of the Commission for the Disappeared Victims of
Violence (KontraS) , committed in September 2004, no substantial
progress has been made to investigate this crime and to bring those
responsible to justice although the Fact Finding Team (TPF) in charge of
investigating this assassination, established the involvement of
high-ranking officers of the State Intelligence Body (BIN).
Therefore we, the participants of the Third Congress of the Asian
Federation Against Involuntary Disappearance (AFAD) guided by the theme -
"Coming Together: Forging a Global Respect for the Right not to Be
Disappeared" - held in Kathmandu, Nepal, from December 16 to 18, 2006,
RESOLVE hereby to strongly urge the Indonesian government to undertake the
following measures:
To seriously conduct the investigation into the case of Munir until the
cause and masterminds are identified, brought to court and punished and,
to do so, to give full support to the police investigators as well as to
give order to the State Intelligence Body (BIN) to fully cooperate with
the investigators.
To make public the results of the work of the Fact Finding Team (TPF) as
stipulated in the presidential Decree that set up the Team.
To invite the Special Rapporteur on Extrajudicial Executions, Mr. Phillip
Alston, for an official visit to the country.
Concerning the cases of enforced disappearances in 1997-98, to conduct a
thorough and impartial investigation and effect prosecution through the
Human Rights Court as the inquiry carried out by the National Commission
on Human Rights (KOMNAS HAM) has characterized them as a crime against
Humanity and as a continuing offence.
In relation to the cases mentioned above, to invite equally the UN Working
Group on Enforced or Involuntary Disappearances (UNWGEID) for an official
visit to the country.
